Resumen

Este libro es el resultado de una investigación doctoral en psicología que indagó la posibilidad de que los adolescentes asuman la responsabilidad por los crímenes realizados, lo que Lacan denominó asentimiento subjetivo. Esta investigación parte de una concepción de sujeto como efecto de la cultura, sobredeterminado por los escenarios que lo instituyen, por lo cual las posibilidades de que el autor de un crimen asuma su responsabilidad están estrechamente ligadas a las respuestas que la sociedad le dé a su acto. A estas últimas las ubicaremos como un ritual que denominaremos Sistema Penal Adolescente.

El autor se indaga si las liturgias penales destinadas a adolescentes favorecen o dificultan el asentimiento subjetivo, para ello recorre a preguntas tales como: ¿Qué marcas inscribe el Sistema Penal en la subjetividad del adolescente? ¿Cuáles de ellas favorecen el asentimiento subjetivo? ¿Cuáles lo dificultan? ¿Estas liturgias transmite acerca de lo permitido y de lo prohibido? ¿Puede poner a circular la ley nuevamente, allí donde ha sido cuestionada por el crimen?

La investigación cuenta con un material de trabajo privilegiado gracias al desempeño del autor como miembro de los equipos técnicos de dos dispositivos del Sistema Penal Adolescente de Tucumán (Argentina), por lo cual pone a disposición del lector un considerable número de casos en los que se llevaron a cabo procesos clínicos. Esta amplia casuística dará testimonio de las marcas subjetivas que el Sistema Penal imprime sobre estos sujetos, y permitirá analizar y buscar respuestas a las preguntas planteadas; también incluye testimonios directos de diferentes actores estratégicos como ser jueces, funcionarios judiciales y gubernamentales, psicólogos, etc.

Esta articulación permite pesquisar las consecuencias del crimen en el sujeto que lo llevó a cabo, como así también la cuestión de la responsabilidad subjetiva del criminal o asentimiento subjetivo. Es decir, indaga la posibilidad de que un sujeto introduzca su acto en su historia y reconozca allí una culpa que le compete, lo cual le permitirá responsabilizarse y reconstituir, de este modo, la ley simbólica que lo sostenía, y que había sido dañada por su crimen.

Abstract

This book is the result of a doctoral research in psychology that investigated the possibility of adolescents assuming responsibility for their crimes, which Lacan called subjective assent. This research is based on a conception of the subject as an effect of culture, overdetermined by the settings that institute it. Therefore, the possibilities for the perpetrator of a crime to assume responsibility are closely linked to the responses society gives to their act. We will situate the latter as a ritual that we will call the Adolescent Penal System.

The author investigates whether penal liturgies intended for adolescents favor or hinder subjective assent. To do so, he addresses questions such as: What marks does the Penal System inscribe on adolescent subjectivity? Which of them favor subjective assent? Which hinder it? Do these liturgies convey information about what is permitted and what is prohibited? Can the law be reestablished where it has been challenged by crime?

The research has privileged working material thanks to the author's work as a member of the technical teams of two units of the Juvenile Criminal Justice System in Tucumán (Argentina). Therefore, it provides the reader with a considerable number of cases in which clinical trials were carried out. This extensive case study will reveal the subjective marks that the Criminal Justice System leaves on these individuals and will allow for analysis and the search for answers to the questions posed. It also includes direct testimony from various strategic actors such as judges, judicial and government officials, psychologists, etc.

This articulation allows for an investigation into the consequences of the crime on the individual who committed it, as well as the question of the criminal's subjective responsibility or subjective assent. That is, it explores the possibility of an individual inserting their act into their history and thereby recognizing a guilt that concerns them, which will allow them to take responsibility and thus reconstruct the symbolic law that sustained them and that had been damaged by their crime.
